Supreme Court Gets Ready to Look at Travel Ban Case

A second US appeals court has ruled against President Donald Trump's revised travel ban, delivering on Monday the latest in a string of defeats for the administration's efforts to limit travel from several predominantly Muslim countries.

On Monday, a three-judge panel of the Ninth Circuit Court of Appeals ruled against a revised version of the executive order, using the President's tweets against him in making their decision.

The Ninth Circuit panel ruled that the travel ban does not account for why allowing the entry of nationals from the six targeted countries under "current protocols" would harm USA interests.

"Well, as predicted, the 9th Circuit did it again - Ruled against the TRAVEL BAN at such a risky time in the history of our country", Trump posted on his Twitter account Tuesday, adding, "S.C." in an apparent reference to the government's appeal to the Supreme Court.

The judges added the government had failed to prove "any link between an individual's nationality and their propensity to commit terrorism", and cited a 5 June tweet by Trump to back their argument.

That went one step farther than the Fourth Circuit Court of Appeals, which only upheld the part of the measure naming the specific countries. The court also didn't mention if the ban breached the US constitution and even said courts should be extremely careful not to issue unnecessary constitutional rulings, apparently referring to the previous ruling by the district court in Hawaii. The court slams the administration for failing to provide minimal support for its draconian action: "We reject the first three reasons provided in Section 2 (c) because they relate to preservation of government resources to review existing procedures and ensure adequate vetting procedures".

The Trump administration has asked the Supreme Court to immediately reinstate its ban on travelers from six mostly Muslim countries, saying the US will be safer if the policy is put in place.

Immigration officials would have 90 days to decide what changes are necessary before people from Iran, Libya, Somalia, Sudan, Syria and Yemen may resume applying for visas. The letter also requested that the new set of papers be filed by June 21, one day before the Supreme Court is scheduled to meet for its final private session before they break for the summer. The federal court decided in line with the other courts that have blocked the president's executive order Protecting the national from foreign terrorist entry into the United States. The court typically also has the last word when a federal court strikes down a law or presidential order.
